Introduction

Year after year, despite regulatory frameworks, enforcement activity, and industry campaigns, workers continue to die from falls that were preventable. The statistics are stark: fall protection is consistently among the most violated safety standards inspected by regulators on both sides of the Atlantic, and falls account for nearly a third of all construction injuries.
Understanding fall protection is not about memorising regulation numbers. It is about genuinely understanding the hierarchy of protective measures, knowing what each system is designed to do, and applying that knowledge on site before anyone steps near an edge, a roof, a scaffold, or an opening in a floor.

The Legal Framework
Fall protection in UK construction is governed primarily by the Work at Height Regulations 2005 (WAHR 2005). These regulations apply to all work at height where a person could be injured by falling, regardless of the height involved. The popular belief that the Regulations only apply above two metres is a myth — if a fall could result in injury, the Regulations apply.
WAHR 2005 establishes a clear hierarchy of control that employers must follow. This hierarchy is not a menu of options — it is a sequence. You must work through each level before moving to the next.
The Work at Height Hierarchy:
- Avoid work at height where it is reasonably practicable to do so
- Prevent falls using collective protective measures where work at height cannot be avoided
- Mitigate the consequences of a fall using systems designed to arrest or limit its effects
This hierarchy shapes every fall protection decision on site. A risk assessment that jumps straight to harnesses and lanyards without considering whether scaffolding, working platforms, or MEWPs could eliminate the hazard entirely is not following the legal framework correctly.
The CDM 2015 regulations also apply, requiring the principal contractor to plan, manage, and monitor fall protection as part of the Construction Phase Plan. Any work at height should be addressed specifically within the CPP, with controls proportionate to the risk.
Level 1: Avoid Working at Height
The first question is always: can this task be done from the ground? Prefabrication, pre-assembly, and modern construction methods have made it possible to complete significant elements of construction at ground level that previously required workers to be at height.
Examples include:
- Pre-assembling roof trusses on the ground before lifting into position
- Installing M&E services in modules that are crane-lifted into position
- Using long-reach tools for tasks such as painting, fixing, and installation that would otherwise require elevated access
- Designing buildings so that maintenance and cleaning can be carried out from the ground or from fixed, permanently installed safe access systems
Not every task can be avoided, and in practice most construction work involves some element of working at height. But the question should be asked — and documented — before the decision is made that height work is necessary.
Level 2: Prevent Falls — Collective Protection Systems
Where working at height is necessary, the first priority is to prevent falls from occurring at all, using measures that protect all workers in an area without requiring each individual to take a specific action. These are collective protection measures.
Scaffolding
Scaffolding is the most widely used collective fall protection system in UK construction. A properly erected, inspected, and maintained scaffold provides a working platform with guardrails, mid-rails, and toe boards that prevent workers from falling over the edge.
Key requirements for scaffolding safety:
- Erection, alteration, and dismantling must be carried out by a competent person (typically a trained scaffolder, SG4:22 or equivalent)
- Scaffolding must be inspected by a competent person before first use and after any significant alteration, adverse weather, or period of non-use exceeding seven days
- Inspection records must be kept on site
- Loading must not exceed the scaffold’s rated capacity
- Access and egress must be safe at all times
Mobile Elevating Work Platforms (MEWPs)
Scissor lifts, cherry pickers, and boom lifts provide a safe working platform for tasks that cannot be served by traditional scaffolding. MEWPs are popular for tasks such as cladding installation, M&E work, and maintenance on larger structures.
MEWP safety requirements include:
- Operators must be trained to use the specific type of MEWP
- The ground surface must be assessed for stability before deployment
- Safe working loads must not be exceeded
- Fall arrest harnesses must be worn by operators of certain MEWP types (particularly boom lifts), connected to the anchor points provided
- MEWPs must be inspected under LOLER (Lifting Operations and Lifting Equipment Regulations 1998) before use
Edge Protection Systems
Any open edge where a worker could fall must be protected with a suitable guardrail system. This typically comprises:
- A top rail at a minimum height of 950mm above the working surface
- A mid-rail at approximately half the height of the top rail
- A toe board at least 150mm high to prevent tools and materials from being kicked over the edge
Edge protection must be capable of withstanding a reasonable load — it is not sufficient to erect a single tube and clip as a token barrier. The design and installation of edge protection systems should be assessed by a competent person.
Working Platforms
Any platform from which work at height is carried out must be of sufficient width for the work, free from trip hazards, and capable of supporting the workers and materials placed on it. Platforms must be inspected before use and, where the platform is at a significant height, inspected by a competent person in accordance with WAHR 2005.
Level 3: Mitigate Falls — Fall Arrest Systems
Where collective protection is not reasonably practicable — for example, during certain roofing operations, on complex structures, or during brief access to unprotected areas — fall arrest systems are used to limit the consequences of a fall that does occur.
It is essential to understand that fall arrest systems do not prevent falls. They are designed to stop a fall at a safe distance and reduce the forces experienced during arrest. They are the third tier of protection, not the first.
Safety Nets
Safety nets installed below a working area will catch a falling worker (or materials) and limit the fall distance. They must be installed as close as possible to the working level to minimise the free-fall distance, and must be inspected and certified to EN 1263.
Safety nets are commonly used during steel frame erection, pre-cast concrete installation, and roof construction where large open areas create falls risks that cannot easily be managed by edge protection alone.
Soft Landing Systems and Crash Decks
Crash decks are temporary platforms installed beneath a working area to catch a falling worker. They are an alternative to safety nets in situations where nets would be impractical — for example, where the working area above is narrow or the structure below would not support net fixing points.
Soft landing systems (airbag-style systems) are an emerging alternative, particularly useful in conversion and refurbishment projects where the structure above and below the working area does not lend itself to net or deck installation.
Personal Fall Arrest Equipment (PFAS)
Where collective protection and fall arrest systems are not practicable, personal fall arrest equipment — comprising a harness, energy-absorbing lanyard or self-retracting lifeline, and a suitable anchor point — is the final layer of protection.
PFAS requirements include:
- Equipment must be selected, used, and maintained by a competent person
- Workers must be trained in the correct use of their equipment before using it on site
- Anchor points must be capable of withstanding the forces generated during a fall arrest — a minimum of 12kN is typically specified
- The total fall distance (free fall plus lanyard stretch plus worker height) must be calculated to ensure the worker does not strike the ground or a lower level before arrest
- Equipment must be inspected before each use and formally inspected by a competent person at regular intervals
The Most Common Failures in Fall Protection
Despite widespread awareness of the legal requirements, falls continue to happen. The most common failures seen by HSE inspectors and safety investigators are:
Inadequate planning. Fall protection is considered only when workers are already at height, rather than being designed into the construction sequence from the outset.
Incomplete edge protection. Guardrails that are installed but then removed to allow access and not reinstated, or that have sections missing because a contractor needed to pass materials through.
Incorrect harness use. Harnesses worn but connected to unsuitable anchor points, lanyards of incorrect length for the working height, or energy absorbers that have already been deployed and not replaced.
Complacency on familiar tasks. Falls frequently occur during tasks that experienced workers consider routine — accessing a roof slope to measure for a detail, stepping over a guardrail to reach a fixing. The familiarity of a task does not reduce the consequence of a fall.
Inadequate inspection. Scaffolding that has been altered or damaged but not re-inspected before workers continue to use it.

- Confirm that your Construction Phase Plan addresses the hierarchy of fall protection for each phase of work
